Terms and Conditions

1. Definitions:

Event: any conference or awards ceremony organised by the Organiser;

Organiser: National Coaching Foundation trading as UK Coaching (Company No: 2092919 and registered office at Chelsea Close Off Amberley Road, Armley, Leeds, West Yorkshire, LS12 4HP)

Website: www.ukcoaching.org or www.ukcoachingconference.co.uk

Customer: the person, company or organisation identified as paying for an Attendee to attend

Attendee: the person (may include a customer) registered to attend the Event;

Venue: the location(s) booked by the Organiser to host the Event; and

Materials: any documentation either printed or electronic provided at the Event.

2. Registration and acceptance:

2.1 All Attendees under the age of eighteen years must obtain parental consent in order to register for and attend the Event.

2.2 The Attendee (and their parent/guardian if under eighteen) is deemed to accept these terms and conditions upon registering for the Event and is responsible for ensuring the details submitted are accurate.

2.3 Attendees confirm that they are fit and well to participate in any physical activity that they choose to take part in during the course of the Event.

2.4 Where a Customer completes the registration on behalf of the Attendee, the Customer is responsible for ensuring all details submitted are accurate and shall procure that the Attendee agrees and will abide by these terms and conditions.

2.5 Attendees should notify the Organiser of any change of registered details as soon as practicable via email to events@ukcoaching.org.

3. Tickets:

3.1 The ticket price for an Event is as detailed on the online booking system on the Website and will be the fee applicable at the date of booking.

3.2 Tickets cannot be cancelled and are non-refundable.

3.3 Tickets can be transferred in accordance with these terms and conditions.

3.4 Ticket sales will close on the earlier of 09:00 on the 12th working day preceding the date of the Event or the date on which all tickets have been sold.

4. Transfer of tickets:

4.1 Attendees no longer able to attend the Event may transfer his/her ticket to another person provided both the name and details of the Attendee no longer able to attend and all details of the person attending in their place is provided in good time and no later than 12 working days preceding the date of the Event.

4.2 Transfer requests must be made in writing to events@ukcoaching.org

4.3 All bookings made by the original Attendee will transfer to the replacement Attendee and no changes (such as workshop selections or seat allocations) will be made.

5. General Data Protection Regulation (GDPR):

5.1 All data will be processed in accordance with the Organiser’s Privacy Statement available on the Website.

5.2 Through agreement of these terms and conditions, the Attendee agrees to the Organiser storing his/her personal data and to the Organiser using this information for the purpose of organising the Event as detailed in the Privacy Statement.

5.3 In compliance with the GDPR, the Attendee has the right of access to his/her personal records held by the Organiser.

5.4 Attendee details will only be added to the Organiser’s mailing list if they agree consent by opting in to receiving marketing. If an Attendee does not wish to receive any marketing information he/she can indicate this on the registration form by not opting in. Attendees are able to unsubscribe from marketing communications at any time.

6. Use of image:

6.1 The Attendee consents to the Event being filmed, recorded or exploited by means of television, film, video or other broadcast or media format and agrees to the use and reproduction of his/her name, likeness, appearance and photograph.

6.2 If the Attendee does not wish for their image be used, they should contact the Organiser via email to events@ukcoaching.org.

6.3 All such commercial rights of any film, photograph or other media format belong entirely to the Organiser.

7. Personal Items

7.1 Items belonging to or in the possession of the Attendee whilst attending the Event are the sole responsibility of the owner.

7.2 Cloak areas may be provided at the Event but are to be used and personal items left entirely at the Attendees own risk. The Organiser and Venue do not accept any responsibility or liability for such items or for damage or loss resulting from such use.

7.3 Attendees using any car parking available at the Venue do so at their own risk and neither the Organiser or Venue accept any responsibility or liability for damage, accident or loss resulting from such use.

8. Venue

8.1 Attendees agree to comply with the Organiser’s and Venue’s policies and procedures at all times during the Event.

8.2 Attendees are responsible for advising the Organiser of any individual needs before the Event.

8.3 The Organiser shall use its reasonable endeavours to ensure that appropriate First Aid assistance will be provided by the Venue for the duration of the Event.

8.4 The Organiser will have a staff presence at the Venue for the duration of scheduled activities of the Event. The Event will be deemed to have to come to a close once the official ceremony or entertainment booked by the Organiser has ended.

9. Event

9.1 The Organiser reserves the right to alter the date(s), timings, programme and speakers for the Event according to circumstance.

9.2 Should a change of date be made and an Attendee be unable to attend on the revised date, he/she may receive a refund of their ticket price providing that they notify the Organiser in writing within 14 (fourteen) days from the date of notification of the change.

9.3 The Organiser shall not be liable for any travel, accommodation or other expenses incurred by Attendees in attending the Event.

9.4 Opinions expressed by speakers at the Event are their own and are not necessarily the views of the Organiser.

9.5 Content of the Event and all Materials belong to the Organiser and/or the Organiser’s consultants/speakers responsible for its development and production. Attendees will not obtain any rights in relation to content and Materials from attending the Event.

9.6 All Materials, products, resources or mementos provided to Attendees at the Event will be limited to one per Attendee.

9.7 The Organiser shall not be liable for any injury or loss occurring as a result of attending the Event (including, without limitation, any losses resulting from the Organiser’s negligence), provided that nothing in these terms and conditions shall exclude or limit the Organiser’s liability for death or personal injury resulting from the Organiser’s negligence or for any other type of liability that cannot be excluded or limited by law.

9.8 The Organiser reserves the right to refuse admission to any person it considers to be unsuitable for admission or to remove any such person after commencement of the Event.

10. Event cancellation

10.1 The Organiser reserves the right to cancel the Event; the Organiser shall not be liable for any losses incurred by Attendees as a result of cancellation of the Event, except that Attendees may request a refund of the ticket price within 30 (thirty) days from receipt of the cancellation notification.

10.2 Force Majeure – the Organiser shall be entitled to cancel, postpone or change the Event if it is deemed necessary to do so as a result of a ‘Force Majeure’ event (an event beyond the reasonable control of the Organiser) and the Organiser shall not be liable for any loss, damages or expenses incurred by the Attendee as a result (including as a result of its negligence) except in respect of losses that cannot be excluded by law.

11. Limitation of liability:

11.1 Except in respect of liability for death or personal injury resulting from its negligence or any other liability that cannot be excluded or limited by law, the Organiser’s total liability, whether for damages or compensation of any nature arising out of or in connection with the Event (including as a result of negligence) shall be limited to a sum equal to the total ticket price paid by the Attendee to the Organiser.

11.2 Attendees agree to indemnify the Organiser in relation to any claims, action, liabilities or losses resulting from any breach of these conditions by the Attendee.

12. General:

12.1. The Organiser may vary these terms and conditions from time to time and up to date terms will be made available on the Website.

12.2 Nothing in these terms and conditions shall constitute any partnership between the Organiser or any third party nor will any third party infer any rights or authority with which to bind the Organiser.

12.3 These conditions shall be governed and construed in accordance with the Laws of England and Wales and any dispute that may arise between parties shall be subject to the exclusive jurisdiction of the English Courts.
